This is a prime example of a real frivolous lawsuit. It is also a form of economic terrorism and continuation of legal “reform” that reforms citizens out of their day in court.

This suit is the kind often called a "Slapp Suit."

"Strategic lawsuit against public participation."

It's a moniker to describe lawsuits brought against community people with few resources as a way to silence them. The idea is that their resources (time, money, energy) will be consumed having to defend themselves, plus the lawsuit by its nature will cause them to not speak about the issue they critically spoke out about in the first place.

Think about it. A community activist sued by a massive corporation like Helena for insisting his family is being subject to pollution.

Another reason I don't like lawyers – they are trained to win, not to do what's right. Sad to say, the only people that will benefit from cases like these are the lawyers. The New Mexico Environment Department should come in on the side of Uribe. If I read your story correctly, the State seems to think there was enough wrongdoing to levy fines, so how could there be “defamation and slander”?
