The subpoena issue is only a starting point. King was on Eye on NM last Sunday. He described the Commission role as "advisory". The Commission is supposed to draft a Code of Ethics which is then distributed to various State officers (Sec of State, Treasurer, Land Commissioner, etc.) for them to adopt as they see fit. As AG King observed, they deal with ethics issues differently. The Commission is authorized to assess penalties as allowed by the statute, but no penalties are incorporated in the statute language. This is a great example where having a citizen initiative provision in our Constitution would be a plus. That way it's the voters who can say "our way or the highway".

Kudos to the Independent for getting this story. The idea of handing the Ethics Commission's subpoena power to the AG is simply a recipe for thoroughly politicizing and short-circuiting future corruption investigations. It renders the Commission a joke. Just consider King's record of inaction and delay on the government corruption cases already in his charge. Honestly, if some of these Democrats take comfort in the prospect of Gary King riding herd on an ethics commission today, what the hell happens when the next Hal Stratton comes along and moves into the AG's chair? What a bunch of short-sighted boneheads. They've got a chance to do the right thing and it's beyond their grasp! Wake up Dede, you've been had.
