A former state investment officer who has alleged a pay-to-play scheme at two state agencies has subpoenaed records for a foundation linked to Gov. Bill Richardson.
Frank Foy, a former chief investment officer at the Education Retirement Board, previously filed a civil complaint alleging that pressure was exerted on officers at his former agency and at the State Investment Council to make investments that would reward political campaign contributors of Richardson.
Now Foy is seeking information into the Moving America Forward Foundation, a nonprofit organization set up by Richardson that took in $1.7 million. Its contributors have not been made public.
“Because MAFF is shrouded in secrecy, no one knows whether Moving America Forward Foundation was used as a conduit by people who wanted to buy business from the State of New Mexico,” said Foy’s attorney, Victor Marshall, in a news release.
The subpoena calls for any and all documents related to:
The board of directors of the foundation, including minutes or notes of any board meetings.
The management of the foundation, including minutes or notes of any management meetings.
Contributions and expenditures, receipts and disbursements, including contributions which were discussed but never made.
All records relating to any employee, officer, or director of the foundation.
Any contracts in excess of $1,000.
Financial or tax records.
“The request includes records in any form, including electronic records like e-mails, cell phone messages, recordings, computer data, etc,” the subpoena says.
The records must be produced by Feb. 19, according to the subpoena.
