This is so rediculous.
The test should be given in confidentiality. However, the test itself should be under scrutiny. For instance, the candidates for officers should have not only questions but weighing nearly as strong should be character choices. Situations where decisions would be made where judgement would be the main factor.
That should supercede intelligence test.

Professor Ford explained his view in the story, which is linked above. Here is the pertinent passage:

"The idea, then, isn't to make an employer hire less qualified women or minorities over more qualified men or whites. It's to make sure the employer is testing for job qualifications, not unrelated ones.

Race discrimination has locked minorities into poor neighborhoods with failing schools for generations: As a result, blacks, as a group, continue to perform less well on written exams than other races. Perhaps New Haven's black candidates could overcome these disadvantages by studying harder, like Frank Ricci did. But Ricci took extraordinary steps to ace the test—six months off work to prepare and $1,000 on tutoring. An equal-opportunity law that's premised on everyone taking such steps isn't likely to do much good in the real world of scarce time and money. And would encouraging the equivalent of intense cramming for the final really help employers select the best firefighter for the job?

Prohibiting tests that needlessly screen out underrepresented groups is a sensible way to ensure that employers have both qualified and integrated work forces. That's why Sotomayor and the 2nd Circuit rejected Ricci's claim."

How can a test favor one race over another? I don't get it.

Is Professor Ford really saying that it's ok to racially discriminate against white people?

I personally would really like my firefighters to be the most competent, regardless of the racial make-up.

You are right, it should, but it's not, because bigoted people do not hire or promote minorities and women. What do you propose to address that? Nothing?

Afirmative action is no more than reverse discrimination. Promotions and hiring should be based on qualifications not color. This ruling is wrong, but will probably stand because of our liberal judges.

So let me get this right....A non-discriminatory multiple-choice test causes fear of lawsuit as being discriminatory.... This line of thinking is equivalent to allowing thieves to sue their victims for any injuries caused during their arrest. I guess I'm not a scumbag lawyer that can argue this infinite loop of hysteria. This must also be how we got a Community Organizer for a President, a Tax Cheat heading up the IRS, and a failed journalist running Detroit. Now we have this - a partisan judge for a nominee to the Supreme Court. Lady Justice is no longer blind !
