By the way, you cannot falsify an invoice if you had the legal authority to create, amend, alter, or change the invoice to begin with- as I beleive the elected official has the legal authority to do. What idiot came up with these charges? What Kind of idiot are you Heath to suggest that the fact that these four individuals knew each other is significant. Thats like saying because the UK and France know each other and have such a long history together, they would conspire against the Soviet Union and fight together against them. Laughable...
They didn't do that at the founding of the U.S.A. nor would they do that with U.S.S.R.
The only area I beleive the prosecution has a chance on is tax issues. They know that too. Its the only area where the rules can be changed by the prosecution at random 'willfully' and it will be backed by the government. I believe this is where the primary focus will be because the rest of the case is unprovable. Its the only area that someone can go to prison because there was a difference of a penny in reporting. Yes a penny's difference makes a world of difference to these guy's. The rest is just a game to skew the numbers and obtain a conviction. Fraud, money laundering, etc. All they have to do is change one fact, and they have a conviction under tax evasion. Old IRS game. A good attorney will eat the prosecution up with this, and a bad one will get them convicted.
It will be intersting to see what kind of attorneys they all have.

Almost all politicians, lobby consultants, judges, etc. know each other mostly through party affiliation. Most of them have known each other for many years and have worked together on countless projects and through a common interest; political elections. The question then becomes did each individual charged in this case have the authority to enter into contract, or to pay and or receive funds for services rendered, and was there an 'established history' of providing the types of services that they are accused of employing for the soul purpose of engaging in the alleged crimes? Was it a crime to hire people you know and possibly trust to do a job, or do public officials have to employ strangers only?
In other words; does the ‘elected official’ have the ‘authority’ to solicit, enter into contract with, and to provide payment for, services and goods rendered? Is there a legal criterion that these individuals must be unknown to the elected official? Did these so called lobbyists and media consultants really have an established history of rendering these types of services that they received funds for? If they did not, then they entered into these professions for the express purpose of defrauding the taxpayer in a conspiracy as the prosecution claims. If they do have such a history in these professions, then Attorney General Gary King has an idiot renegade prosecutor that he has given free reign too, who has in turn, just set the state of New Mexico up for a potential major law suit that will pay these four individuals millions in taxpayer money in a wrongful prosecution lawsuit, defamation of character, and a whole lot of other grounds. Gary King is no Bruce King I can tell you that, and they are gambling a-lot on proving that these four individuals conspired to defraud the taxpayer; with-out a shred of evidence I might add, that I see except that they have all known each other for a long time, and that money had changed hands, for what appears to me by the records to be a legitimate purposes. Rebecca Vigil-Giron hires and uses the lobby firm employing the Kupfers to lobby the NM Legislature on her behalf. This is a common practice to get laws changed or to try to get allocation of funds for particular projects, etc. A media consultant hires the same lobby firm for his particular interests representing his media business from Texas, whom is also conducting business in New Mexico. Vigil-Giron consults with her hired consultant the Kupfers, a friend or not, on a media issue that she needs to get information to the public and how to do it. One consultant suggests another consultant that specialized in that field, Vigil-Giron hires him, and wha-la, and we have a full blown conspiracy. What planet are we living on? Is Gary King that stupid? What is really driving this prosecution? Was one of these prosecutors in this case previously fired by one of the Kupfer’s like I hear? Is that what’s behind this? Do your homework Heath and answer the question. Were any of the prosecuters working this case formerly fired by one of the Kupfers? Is this a personal vandetta case-which is obviously supported by Attorney General Gary King?

Had the Secretary of State's office kept more complete records, for a longer time, this scandal might have been deterred or resolved. <a href="http://legal-beagle.typepad.com/wrights_legal_beagle/2009/02/e-mail-archival-in-government-administration.html" rel="nofollow">http://legal-beagle.typepad.com/wrights_legal_b...</a> --Ben

It would be interesting to be able to see exactly what the HAVA money paid for in terms of the Public Service Announcements and Poll Worker training videos involved in this case. Note that an additional poll worker training video was made for and used later by the current Secretary of State, which judging by it's content is probably the one that's mistakenly referred to "Vigil-Giron, Video An Embarrassment" in a letter to the editor in today's Journal: (<a href="http://www.abqjournal.com/opinion/letters/032148479723opinionletters09-03-09.htm" rel="nofollow">http://www.abqjournal.com/opinion/letters/03214...</a>)

Note to self...<br><br>"If you think someone is doing a good job on one project, then don't ever hire them for another one!"<br><br>"Oh yeah and lest I forget, don't ever hire anyone you know or ever met socially for a job no matter what, because apparently that is bad for some reason..."<br><br>What is the point of this story? To "prove" that they knew each other and worked together on more than one project? I think that's already been established. You know what hasn't been established Heath? <br><br>That Rebecca did anything wrong, period. Nice try though!!
