Execution is a false penalty because everyone dies. Deserving has nothing to do with a natural process in life. To live is to die. We are dying from our moment of conception. It is our culture's immature fear of death that causes so many problems in our society. It is the lack of acknowledgment of the transience of this life that allows so many of us to waste our precious time and lose perspective on what really matters. Using death as a false penalty only perpetuates fear and lies.

OTHER REPORTS: There is the potential for, at least, 3 more, official, reports on this case: the Texas Fire Marshall's office, which will give an official and requested reply, the Corsicana Police Dept. and Navarro County District Attorney's office, both of which, I speculate, may only contribute to the TFM report, but could issue their own reports.

There is an official "report" which, it appears, few have paid attention to - the trial transcript.

I find that rather important because, at least five persons, who were involved with the trial, the prosecutor, defense attorney, two surviving fire investigators and a juror have all voiced support for the verdict, still, in the light of the criticism of the arson forensics.

One of those original fire investigators is, now, an active certified arson expert.

If Herrera had gone to the Supreme Court this year he would have met with the spirit of Rehnquist still dishing out his absurdist, pedantic logic. Rehnquist, who died in 2005, would probably have voted with the 5-4 majority of the court that maintained suing for DNA testing was not a right guaranteed to a person convicted of a capital crime.

Channeling the dead now are we Price?
