Yup, Foy is just a mudslinging GOP operative. There's no way a former chief investment officer at the Education Retirement Board could know anything about pressure being exerted on officers at that agency and the State Investment Council to award contracts and make investments that benefited the Governor's political campaign contributors and ended up costing NM taxpayers 90 million dollars. No doubt the Correras could prove how totally insubstantial Foy's allegations are – if they could be located.

Sanctions intended to keep ethical complaints secret are tantamount to whistleblower intimidation. The intent is really to protect lawmakers and public servants from corruption or misconduct charges, not to protect the public. The US Constitution protects free speech, but as whistleblowers will tell you, its guarantee is worthless. See http://www.nancyswan.com

Also note that under the proposed reform legislation, an incumbent who is a candidate for re-election is immune from any action by the commission until after the election and their possible re-election.

Re: whistleblowing. According to http://roundhouseroundup.blogspot.com/2009/12/r... one of the provisions of the bill to establish a NM Ethics Commission, which recently received unanimous approval by a legislative interim committee, includes a provision intended to keep all material related to an investigation confidential. Section 16 of the proposed bill states: “A person who discloses any confidential complaint, report, file, record or communication in violation of the State Ethics Commission Act is guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than one thousand dollars ($1,000) or by imprisonment for not more than one year or both.” As Jim Scarantino pointed out recently (http://newmexico.watchdog.org/2009/12/10/analys...) this prohibition of disclosure is even more broad than the laws governing grand jury secrecy.
