A bill that would allow concealed handguns in some restaurants that serve beer and wine has been pre-filed for the 2010 legislative session, which begins later this month. The bill, sponsored by state Sen. George Munoz, D-Gallup, would allow concealed handguns in “a restaurant licensed to sell only beer and wine that derives no less than 60 percent of its annual gross receipts from the sale of food for consumption on the premises.”
The establishment, however, could still choose to voluntarily ban handguns by posting a sign “in a conspicuous location at each public entrance, prohibiting the carrying of firearms” or if a owner or manager “verbally instruct[s]” a gun carrier that guns are not allowed in the establishment.
An identical bill passed the House during the 2009 session, but the Senate version of the bill did not pass before the end of the 2009 session. The Senate version of the bill was also carried by Muñoz.
State Rep. John Heaton, D-Carlsbad, sponsored the House version of the bill in 2009, but has not yet pre-filed the bill for the 2010 session.
