Republican gubernatorial candidate Doug Turner said Saturday that he will sue the federal government if the health care reform proposal being considered in Congress is signed by President Barack Obama. A vote is expected in the Senate Sunday.

“As your next Governor, I pledge that if the current healthcare reform legislation is enacted, I will stand with Virginia, Idaho and other states with pending legislation to sue the federal government on the grounds that this bill violates the Constitution by impinging on our state’s rights,” Turner said in a statement posted on his Facebook page.

Turner cited the 10th amendment to the U.S. Constitution, which reads, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Turner attended a “Kill the bill” rally in Albuquerque on Saturday opposing the legislation.

“Today, New Mexico is losing more jobs than it is gaining,” Turner’s statement said. If this healthcare legislation is passed, our already struggling small business market in New Mexico will wither. “
