Supreme Court orders Martinez to publish rules

The New Mexico Supreme Court ruled Wednesday morning that Gov. Susana Martinez’s administration was wrong to halt the publication of rules in the state Register and issued a writ that compels Martinez’s office to publish the rules. This included a greenhouse emissions cap rule passed by the Environmental Improvement Board last year and a rule on dairy regulations had been passed by the Water Quality Control Commission in December 2010.

State Supreme Court sets date to hear enviro lawsuit

The state Supreme Court has set a date to hear a lawsuit from an environmental group that says Gov. Susana Martinez doesn’t have the right to halt publication of regulations passed by the Environmental Improvement Board. The New Mexico Environmental Law Center also announced it would sue Martinez on a dairy regulation that Martinez halted.

Martinez administration responds to environmentalists’ lawsuit

Gov. Susana Martinez’s office responded to a lawsuit by an environmental group which would force publication of environmental rules that Martinez halted last week. The governor’s office issued a statement to the Santa Fe Reporter which appears to be the first public comment on the situation by the administration.

Uranium mining in Churchrock advanced last week as an appeals court cleared the way for Hydro Resources to start in-situ leaching in Northwest New Mexico. But residents and environmentalists worry that the mining will contaminate water. Because of the ongoing issue of abandoned mines that haven’t been cleaned up and a legacy of illness caused by exposure in the mines, the Navajo Nation banned uranium mining of all types in 2005.

Proposed Mt. Taylor uranium mine faces new obstacle

A controversial plan to open an old uranium mine on Mt. Taylor, near Grants is now facing a new obstacle. The Colorado state Legislature just passed a law requiring uranium mills to clean up existing contamination before accepting any new ore. If Colorado Gov. Bill Ritter signs the bill, it will apply to the Colorado mill that is supposed to handle the ore from Mt. Taylor, and could put the mine project on hold.

Uranium mining in Navajo community OK’d by appeals court

A federal court this week gave a uranium company the green light to move forward with mining operations in Churchrock, a Navajo community just east of Gallup, New Mexico. Opponents had argued that since the site already emits more radiation than regulations allow, a license for a new operation can’t be given because any new radiation emitted, no matter how small, would compound the problem.

A sampling of New Mexico environmental leaders cites a wide range of what they consider the biggest issues for the year that was. They include Tax Increment Development Districts, the proposed Desert Rock power plant, river otters, the destruction wrought by all-terrain vehicles in national forests and a new law allowing concealed weapons in national parks. But mostly they wanted to talk politics. Like everyone else, environmentalists were consumed by the 2008 elections and the sea change coming to the Legislature, Congress and the White House.
